NAITSA’s Statement On The Alberta Court Of King’s Bench Judicial Review Of NAIT’s 2022/22 Tuition Model and Consultation with Students:

On August 19, 2021, NAITSA applied for a judicial review of NAIT’s new tuition model on the basis that NAIT had not meaningfully consulted with NAITSA, as was their legal obligation, and that the new model increased tuition on new, full-time students beyond the 10% cap on increases to individual programs that was the policy of Alberta Advanced Education.

On September 12, 2022 the Court of King’s Bench delivered a ruling. The Court ruled that:

1) NAIT had not met its legal obligation to meaningfully consult with students, and;

2) The 10% cap in increases to individual programs was not in force for the 2020-21 to 2022-23 academic years.

NAITSA is currently reviewing this decision and consulting with legal counsel.
